The following is an itemized list of hazardous waste violations that have not been <br /> addressed for BRANNON TIRE- CLAREMONT as of March 13, 2020. <br /> Open violations from January 27, 2020 inspection <br /> Violation #115- Failed to comply with uniform hazardous waste manifest exception requirements. <br /> OBSERVATION The facility did not have exception reports on site for Uniform Hazardous Waste Manifests <br /> (UHWM): <br /> -017792304JJK(3/21/2018) <br /> -0 1 8526640JJK(5/31/2019) <br /> REGULATION: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the <br /> owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial <br /> transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the <br /> status of the hazardous waste. <br /> (b)A generator shall submit an Exception Report to the Department if the generator has not received a copy of the <br /> manifest with the handwritten signature of the owner or operator of the designated facility within 45 days of the date <br /> the waste was accepted by the initial transporter. The Exception Report shall include: <br /> (1) a legible copy of the manifest for which the generator does not have confirmation of delivery; <br /> (2) a cover letter signed by the generator or the generator's authorized representative explaining the efforts taken to <br /> locate the hazardous waste and the results of those efforts. <br /> (d) Generators shall submit the exception report to the department at: DTSC Report Repository, Generator <br /> Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br /> Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be <br /> found then prepare an exception report for each missing manifest as required by Title 22 California Code of <br /> Regulations section 66262.42. The exception report shall include a legible copy of the manifest for which the <br /> generator does not have confirmation of delivery and a cover letter signed by the generator or the generator's <br /> authorized representative explaining the efforts taken to locate the hazardous waste and the results of those efforts. <br /> DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA <br /> 95812-0806.
