The following is an itemized list of hazardous waste violations that have not been addressed for BRANNON TIRE- CLAREMONT as of March 13, 2020. Open violations from January 27, 2020 inspection Violation #115- Failed to comply with uniform hazardous waste manifest exception requirements. OBSERVATION The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (UHWM): -017792304JJK(3/21/2018) -0 1 8526640JJK(5/31/2019) REGULATION: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (b)A generator shall submit an Exception Report to the Department if the generator has not received a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 45 days of the date the waste was accepted by the initial transporter. The Exception Report shall include: (1) a legible copy of the manifest for which the generator does not have confirmation of delivery; (2) a cover letter signed by the generator or the generator's authorized representative explaining the efforts taken to locate the hazardous waste and the results of those efforts. (d) Generators shall submit the exception report to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then prepare an exception report for each missing manifest as required by Title 22 California Code of Regulations section 66262.42. The exception report shall include a legible copy of the manifest for which the generator does not have confirmation of delivery and a cover letter signed by the generator or the generator's authorized representative explaining the efforts taken to locate the hazardous waste and the results of those efforts.
