Infanta has not reviewed his files. It is disevuraging <br /> to be required to prove that Mr. Infurna and his superior, Ms. Hinson at the LOA, were fully <br /> briefed,both orally and in writing of the proposal to perform excavation at the Langston site,and <br /> that they approved excavation in writing before it occurred. Not only did Mr. Infurna <br /> approve excavation,he personally directed its expansion far beyond that which was contemplated <br /> in the interim work plan. See the narrative provided by WHF, attached as Exhibit "D" <br /> I direct your attention to rite documents organized in chronological order and <br /> attached hereto as Exhibit "E"_ These documents establish the following facts_ <br /> • Some time prior to October 15, 1994, Michael tnfurna of the LOA contacted <br /> Michael Kloberdanz of WHF and requested a completed Retnedial Excavation Work Plan for <br /> Langstone Market, <br /> i On October 25, 1994, Mr Kloberdanz sent a copy of the Remedial Excavation <br /> Work Plan to Mr, Infuma with a cover letter. A true and correct copy of that Remedial <br /> Excavation Work Plan is included in the second Reimbursement Request at Tab 4 of Volume 3. <br /> • Some time prior to November 23, 1994, Mr. 1hfurna phoned Mr. Kloberdanz <br /> and asked for a "Corrective, Action Executive Summary". This document is somewhat akin to <br /> "Cliff Notes". It condenses and simplifies the concepts and facts stated in the lengthier <br /> document. <br /> • On Novetnbet 23, 1994,Michael Kloberdanz sent a copy of WHFs Corrective <br /> Action Executive Summaty to Mr. Infurna. A true and correct copy of this document is attached <br /> hereto as part of Exhibit "E". <br /> The Corrective Action Executive Summary stated that contamination at the <br /> I.angstons' property migrated down to the water table, "with lateral spreading." The Summary <br /> went on to explain that "Approximately 3,000 tons (2,OW cubic yards) of soil will he <br /> excavated..," <br /> • On Dem ember 1, 1994, Mr. Infurna wrote to Mr. Langston and approved the <br /> work plan, which he characterized as "an interim activity." In that letter, he anticipated a <br /> subsequent Final Remediation Plan (Corrective Action). He also stated that: "Over-excavation <br /> and soil sampling shall be under the witness of PHS-EHD personnel__." Finally, Mr. Infurna <br /> stated that. "Tlte Executive Summary ,ulatnitte d on November 28, 1994 is approved..." The letter <br /> was signed by Michael Infurna and his superior, Diane Hinson. <br />
