Box 8008 <br /> Stockton, CA 95208-0008 <br /> Dear Mr. Patten: <br /> UNDERGROUND STORAGE TANK (UST) LOCAL OVERSIGHT PROGRAM, SITE NO. 2180, SAN <br /> JOAQUIN COUNTY <br /> This is in response to your letter to Ms. Jaqui Sikoryak dated July 6, 1992 <br /> regarding our invoices for oversight services by San Joaquin County Public <br /> Health Services (County) . Your letter stated that you felt the bilis were <br /> uncalled for and gave several reasons for your position. <br /> M We understand that paying for oversight services in addition to paying for the <br /> actual costs of cleaning up contamination from underground storage tanks is a <br /> --- major burden for many small businesses and individuals. However, we are <br /> required by law to bill the appropriate responsible parties for the oversight <br /> costs. Since Patten Steel Company (Company) owned the tanks and property in <br /> June 1986 when the tanks were removed and' soil samples indicated the presence <br /> of contamination, the Company is considered responsible for the costs of <br /> cleaning up the site. <br /> The County has stated that, at your request, your site was placed into the <br /> Local Oversight Program for corrective action. The County notified you of <br /> this fact by letter on August 14, 1990 (copy enclosed) . The letter gave an <br /> explanation of the County's role in this program and also your <br /> responsibilities. The letter specifically stated "The State Water Resources <br /> Control Board (SWRCB) will invoice you directly for activities performed under <br /> the auspices of the Local UST Oversight Program. " <br /> Your previous letter to us dated June 24, 1990 had enclosed a copy of the <br /> Voluntary Petition for Patten Steel Company filing Chapter 7 Bankruptcy in <br /> January 1990. The bankruptcy only covers what was addressed and ordered <br /> relieved on January 25, 1990. Since our oversight charges were incurred in <br /> August and September 1990, they were not included in the bankruptcy and the <br /> Company remains responsible for payment of the costs. <br /> In order to provide you with additional information regarding the oversight <br /> activities performed for your site, we requested a detailed description of the <br /> site-specific charges included in the enclosed invoice for $1,303.66. We have <br /> enclosed a copy of the County's response.
