SAN J OAQU I N Environmental Health Department <br /> CC LJ N T Y------- <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> J &H MARINE, INC 401 N SAN JOSE ST, STOCKTON May 20, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 111 CCR 66262.42(a)(c)(d)Failed to comply with uniform hazardous waste manifest exception requirements. <br /> OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests <br /> (UHWM): <br /> -017154116JJK(6/14/2017) <br /> -017154120JJK(6/14/2017) <br /> -016781213JJK(9/18/2017) <br /> -017144562JJK(9/19/2017) <br /> -017144687JJK(10/5/2017) <br /> -018790018JJK(5/22/2018) <br /> -020445105JJK(6/11/2019) <br /> REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten <br /> signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by <br /> the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to <br /> determine the status of the hazardous waste. <br /> (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the <br /> owner or operator of the facility to which the generator's waste is submitted,within 60 days from the date that the <br /> hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the <br /> manifest,with some indication that the generator has not received confirmation of delivery. <br /> (d)Generators shall submit the information to the department at: DTSC Report Repository, Generator Information <br /> Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br /> Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be <br /> found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility <br /> signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information <br /> Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD <br /> within 30 days. <br /> This is a Class II violation. <br /> 113 HSC 25160.2(b)(3)Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts from 6/14/2017 to 1/24/2018, 11/7/2018, 2/23/2019 to <br /> 4/30/2019&6/12/2019 to 1/29/2020 for hazardous wastes were not found on site during the inspection <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from the above date <br /> ranges and maintain them on site.
