SIMPLOT COMPANY, LATHROP, SAN JOAQUIN COUNTY, Case#3876 <br /> This Notice of Noncompliance is being issued to the J.R. Simplot Company for failure to submit <br /> adequate monitoring reports as required by.Waste Discharge Requirements (WDR) Order No. 97- <br /> 229 and Title 27, California Code of Regulations, Division 2, Subdivision 1. As stated in Order No. <br /> 97-229, these reports must comply with Provision D.1 and D.3 which state that, "The Discharger <br /> shall comply with the Standard Provisions and Reporting Requirements dated I August 1997;" and <br /> "The Discharger shall comply with Monitoring and Reporting Program No. 97-229, "respectively. <br /> This determination was based on our review of J.R. Simplot's 1 February 2000, Pond and Well <br /> Water Monitoring Reports for the calendar year 1999 (annual report). Our comments also respond <br /> to your letter of 8 December 1999. <br /> 1999 Annual Pond and Well Water Monitoring Reports <br /> Enclosed is a Monitoring Report Compliance Checklist that we use to evaluate the completeness and <br /> adequacy of monitoring report submittals. The checklist includes requirements from WDRs and <br /> Standard Provision and Reporting Requirements (see attached) in accordance with Reporting <br /> Reouirements E.I. of Order No. 97-229. Please ensure that J.R. Simplot's monitoring reports <br /> address, at a minimum, the elements included within the checklist. <br /> Third Quarter 1999, Pond and Well Monitoring Report letter of 8 December 1999 <br /> Your letter reponds to serveral areas of concern as follows: <br /> 1. Perchlorate: Please provide details on how studies being performed by EPA, The Fertilizer <br /> Institute and other industry apply to the J.R. Simplot site. Even though disposal of perchloric <br /> acid into the ponds has been discontinued, we request that sampling and analysis continue <br /> until sample results show non-detect for four consecutive quarters.
