SIMPLOT COMPANY, LATHROP, SAN JOAQUIN COUNTY, Case #3876 <br /> We have reviewed J.R. Simplot's letters of 4 May, 2000 and 15 June, 2000 responding to the <br /> Board's Notice of NonCompliance (NOC) letter dated 11 April 2000. As of the date of this letter we <br /> have not received the documents as requested in our letter of NOC, therefore J.R. Simplot is in <br /> violation of applicable requirements. We have also reviewed and incorporated comments on the <br /> Second Quarter 2000, Pond and Well Monitoring Report, 31 July 2000 (2nd Qtr.). <br /> As stated in the Board's NOC letter, J.R. Simplot Company is required to comply with the <br /> following applicable documents/requirements: <br /> Waste Discharge Requirements (WDR) Order No. 97-229, which includes Monitoring and <br /> Reporting Program (MRP) No. 97-229; <br /> Standard Provisions and Reporting Requirements, dated 1 August 1997; and <br /> s Title 27, California- Code of Regulations, Division 2, Subdivision 1 (Title 27). <br /> Based upon a conversation with your regulatory compliance staff, it was clear that J.R. Simplot was <br /> not aware of their responsibilities in this regard. Nevertheless, this does not relieve J.R. Simplot <br /> from complying with the laws and regulations promulgated to protect the beneficial uses of the <br /> waters of the State. Our comments follow: <br /> General Concerns <br /> 1. MRP Order No 97-229, B Required Monitoring Reports 4 Constituents-of-Concern (COC 5- <br /> Year Report: <br /> As stated in this section, the review period for the 5-Year report began in 1995, therefore the <br /> year 2000 marks the first review period. The Discharger is required to monitor all COCs for <br /> all Monitoring Points and Background Monitoring Points for each monitored medium in the <br /> California Environmental Protection Agency <br /> 01 Recycled Paper <br />
