Significant Effects and Mitigation Measures
Conditions and/or controls on the project which are agreed to
by the facility and which will be implemented through the closure
plans and other public agency laws, ordinances, regulations, or
standards are described in the Initial Study. Assuming full
compliance with these controls, they are sufficient to limit
project impacts to an insignificant level. Thus, no additional
mitigation measures are required.
Consistency with Existing Zoning, Plans, and other Applicable Land Use
Control
The closure activities are consistent with general maintenance
and equipment decommissioning practices at industrial facilities.
Implementation of the proposed Plan will allow contained operation
of the J.R. Simplot Company facility under its current land use
zoning designation.
Applicable Laws, Ordinances, Regulations, and Standards (LORS)
The applicable LORS include, but are limited to:
STATE
Title 22, California Code of Regulations (Cal. Code of Regs.),
Division 4.5 Chapter 20 for requirements of closure of hazardous
waste facility
Title 8, Cal. Code of Regs., for worker safety.
LOCAL
San Joaquin Valley Air Pollution Control District, Regulation 8,
Rule 8000 for figitive of PM 10 prohibition
Rule 8070 for storage of materials and dust control measures.
CITY
City of Lathrop has no regulations for noise because the site is in
a general industrial area and has no land use impacts
This Initial Study was prepared solely by the
Department of Toxic Substances Control.
