WC-88-8 <br /> Jimmy Jiro Watanabe , et al `L`J IOAQUIN k000NT•i, <br /> Gentlemen• ~PLANNING DIVISION <br /> To support the tentative approval of the above- <br /> referenced application, applicant urges the Board to make the <br /> following findings , required by the Williamson Act ( "The <br /> Act" ) , at the public hearing scheduled for December 15, 1.987 : <br /> That cancellation is in the public interest (Section <br /> 51282 (a ) ( 2 ) of the Government Code ) in that (1 ) other public <br /> concerns substantially outweigh the objectives of the <br /> Williamson Act (Section 51282 (c ) (1 ) of the Government Code ) , <br /> and ( 2 ) there is no proximate noncontracted land which is <br /> both available and suitable for the use to which it is <br /> proposed the contracted land be put, or, development of the <br /> contracted land would provide more contiguous patterns of <br /> urban development than development of proximate noncontracted <br /> land (Section 51282 (c ) ( 2 ) of the Government Code ) . <br /> In support of the first finding set forth in the <br /> preceding paragraph, applicant submits the following: <br /> The objectives of the Act have been variously <br /> described ever since its enactment in 1965 . Most commenta- <br /> tors agree , though, that the legislators intended the Act to <br /> provide property tax relief to growers who were being forced <br /> out of farming by rising taxes on their land, to maintain the <br /> agricultural economy of the state and assure the supply of <br /> adequate food for the residents of the state and nation, and <br /> to discourage the premature and unnecessary conversion of <br /> agricultural land to urban uses . <br /> -3- <br />
