WC-88-8 Jimmy Jiro Watanabe, et al SAN JOAQUIN COUNTY Gentlemen : PLANNING DIVISION To support the tentative approval of the above- referenced application, applicant urges the Board to make the following findings , required by the Williamson Act ( "The Act" ) , at the public hearing scheduled for December 1t, 1987 : That cancellation is in the public interest (Section 51282 (a) (-2 ) of the Government Code ) in that (1 ) other public concerns substantially outweigh the objectives of the Williamson Act (Section 51282 (c ) (1 ) of the Government Code ) , and ( 2 ) there is no proximate noncontracted land which is both available and suitable for the use to which it is proposed the contracted land be put, or, development of the contracted land would provide more contiguous patterns of urban development than development of proximate noncontracted land (Section 51282 (c ) ( 2 ) of the Government Code ) . In support of the first finding set forth in the preceding paragraph, applicant submits the following : The objectives of the Act have been variously described ever since its enactment in 1965 . Most commenta- tors agree, though, that the legislators intended the Act to provide property tax relief to growers who were being forced out of farming by rising taxes on their land, to maintain the agricultural economy of the state and assure the supply of adequate food for the residents of the state and nation, and to discourage the premature and unnecessary conversion of agricultural land to urban uses . -2-
