Publimc a ice <br /> US Army Corps <br /> of Engineers <br /> Sacramento District Public Notice No. 8302 Date: March 14, 1984 <br /> 650 Capitol Mall <br /> Sacramento, CA 95814 In Reply Refer to: SPKCO-O Comments Due by: April 13, 1984 <br /> TO WHOM IT MAY CONCERN: <br /> Subject: Application for a Department of the Army permit to construct new marina facilities in Little <br /> Potato Slough (Mile 3.9), in conjunction with expansion of Tower Park Marina at Terminous, California. <br /> Applicant: Tower Park Inc., 14900 West Highway 12, Lodi, California 95240. <br /> Location: The proposed project is located on the left bank of Little Potato Slough (Mile 3.9), north of <br /> Highway 12 bridge crossing of Little Potato Slough. The project site is adjacent to San Joaquin County <br /> Assessor's Parcel No. 055-030-04, as shown on the attached drawings. <br /> Purpose: The expansion will provide facilities for the repair and maintenance of recreational boats up to <br /> 50 feet long and additional boat berthing. <br /> Project Description: The marina facility will include a 10'x 300'inner and a 112'x 8'outer dock,a marine <br /> travel lift,two stationary marine lifts measuring 20'x 50'and 25'x 60'; project will also include construction <br /> of a 31' x 60.5' boat work shop. There will be no filling or dredging. <br /> Area Description: Vegetation in the area consists primarily of grasses. Bank is rocked to the high <br /> waterline. The area is primarily agricultural with recreational facilities located along the left bank levee of <br /> Little Potato Slough. <br /> Additional Information: The marinas'farthest extension into the slough will be 106 feet from top of bank <br /> and will run parallel 340 feet along the bank. The width of channel at the site is from 300 to 400 feet wide. <br /> The waterward site is presently undeveloped, but the upland property has one abandoned structure. <br /> Permit No.6906 was issued in 1980 for a marina at the site,but the marina was never ui t. lans authorized <br /> by Department of the Army Permit No.6906 are attached.The permit has expired.The Highway 12 bridge is <br /> just downstream of the proposed project and access to the site is off Highway 12.There are no structures on <br /> the opposite bank. <br /> For further information contact the Regulatory Section, Operations Branch, Room 6540, or telephone <br /> (916) 440-2325. <br /> The latest published version of the National Register of Historic Places and its monthly supplements have <br /> been reviewed and there are no places either listed or recommended as eligible which would be affected. <br /> Presently unknown cultural resources may be located in the permit area.This activity would not affect any <br /> threatened or endangered species or their critical habitat. The District Engineer has made this <br /> determination based on information provided by the applicant and on the Corps'preliminary evaluation. <br /> A permit issued by the Department of the Army does not give any property rights either in real estate or <br /> material or any exclusive privileges and does not authorize any injury of private property or invasion of <br /> private rights, or any infringement of Federal, State or local laws or regulations, nor does it obviate the <br /> necessity of obtaining State or local assent to the work authorized. <br /> Interested parties are invited to submit any comments they may have in writing,on or before April 13,1984. <br /> The decision whether to issue a permit will be based on an evaluation of the impact on the public interest, <br /> under authority of Section 10,River and Harbor Act of 1899.That decision will reflect the national concern <br /> for both protection and utilization of important resources.The benefit which reasonably may be expected <br /> to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors <br /> which may be relevant to the proposal will be considered; among those are conservation, economics, <br /> aesthetics, general environmental concerns, historic values, fish and wildlife values, flood damage <br /> prevention, land use, navigation, recreation, water supply, water quality, energy needs, safety, food <br /> production and, in general, the needs and welfare of the people. No permit will be granted unless its <br /> issuance is found to be in the public interest.
