The following is an itemized list of hazardous waste violations that have not been addressed for Lopez Truck And Trailer Repair as of March27, 2020. Open violations from December 10, 2019 inspection Violation#101 - Managed a hazardous waste without an identification number. OBSERVATION This business does not have a hazardous waste ID number in the California Department of roxic Substances Control (DTSC) database. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification (ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to obtain a State ID number . Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. ❑ This violation was corrected ❑ This violation will be corrected by (date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation #102 -Failed to determine if a waste is a hazardous waste. OBSERVATIONS One five gallon blue container was found with used oil filters and one aerosol can and no waste determination being made. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. CORRECTIVE ACTION: Immediately make a hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes.
