Michael Oliphant - 2- 11 March 2014 <br /> Tracy Rail Yard Offsite—West <br /> Shallow groundwater in the vicinity of the Site is not currently used and is not anticipated to be used <br /> in the near future as a municipal or private drinking water supply, and thus the potential exposure to <br /> groundwater was not evaluated in the HHESE. As such, a complete exposure pathway to <br /> groundwater does not exist for current or future Site-use conditions. The HHESE findings indicated <br /> that the risk scenario considered is a conservative estimate and actual risks are believed to be <br /> much lower. Exposure to petroleum hydrocarbons in shallow soil should not result in an <br /> unacceptable health risk for a resident adult or child at the Site or to ecological receptors. <br /> Based on investigative findings, including the risk assessment evaluation, the residual crude oil <br /> associated with the historical TAOC pipelines does not appear to pose an unacceptable risk to <br /> human health or the environment. The groundwater plume appears stable or is shrinking and the <br /> residual crude oil remaining in the soil and groundwater will naturally degrade, likely over a period <br /> of years. A Fact Sheet was distributed to nearby property owners in February 2014 requesting <br /> comments to a no further action request for the Site be submitted within 30 days. Comments from <br /> owners of one property were addressed during a telephone conversation. No other comments were <br /> received. <br /> Provided the information submitted by Chevron was accurate and representative, no further action <br /> is appropriate for the above-referenced property. Please be advised that this letter does not relieve <br /> Chevron of any liability under the California Water Code or Health and Safety Code for past, <br /> present, or future operations at the Site. A no further action designation does not relieve Chevron <br /> of any responsibility to clean up existing, additional, or previously unidentified conditions at the Site <br /> that cause or threaten to cause degradation or nuisance or otherwise pose a threat to water quality <br /> or public health. <br /> Any person aggrieved by this action may petition the State Water Resources Control Board (State <br /> Water Board) to review the action in accordance with Water Code section 13320 and California <br /> Code of Regulations, title 23, sections 2050 and following. The State Water Board must receive the <br /> petition by 5:00 p.m., 30 days after the date of this action, except that if the thirtieth day following <br /> the date of this action falls on a Saturday, Sunday, or state holiday, the petition must be received by <br /> the State Water Board by 5:00 p.m. on the next business day.
