Box 944212 <br /> Sacramento, CA 94244-2120 <br /> Subject: Staff Decision to Reject Claim - Claim No. 017531 <br /> SUTTER OFFICE CENTER <br /> 242 North Sutter Street, Stockton, California <br /> Located at 434 East Miner, Stockton, California <br /> Dear Mr. Patton: <br /> In accordance with a letter from the State Water Resources Control Board - Division of Financial <br /> Assistance(Underground Storage Tank Cleanup Fund), dated 17 December 2003, and on behalf of <br /> our Client,Sutter Office Center,Advanced GeoEnvironmental,Inc. (AGE)is requesting a review of <br /> the ineligibility determination for Claim No. 017531 for the site located at 242 North Sutter Street, <br /> Stockton,California(also know as 434 East Miner Avenue and 448 East Miner Avenue).AGE and <br /> the Sutter Office Center(property owners) hereby appeal the SWRCB Staff Decision which found <br /> their USTCF claim to be ineligible for placement on the priority list and request your review of the <br /> Staff Decision. The appeal and request is based on the following: <br /> 1. Statement Describing How Sutter Office Center Has Been Damaged By The Prior Staff <br /> Decision <br /> The Sutter Office Center has been damaged by the Prior Staff Decision because it found them <br /> to be ineligible for placement on the priority list.A direct finance hardship for costs associated <br /> with the mitigation contamination on the site,without the benefit of cost reimbursement will <br /> occur. Additionally,the letter from the SWRCB,dated 17 December 2003 was not received <br /> by Sutter Office Center, prior to copy by facsimile on 14 January 2004. <br /> 2. Description Of Remedy Or Outcome Desired <br /> The remedy desired by the Sutter Office Center is that they be found to be eligible for <br /> placement on the priority list, Claim No. 017531. <br /> 3.
