SECTION 9-1905.17—CRIMINAL PENALTIES. <br /> Enforcement of violations of this Title may be subject to criminal penalties as follows: <br /> (a) Notice to Appear Citation. If an owner and/or person in possession or control of the real <br /> property involved has committed a violation of this 'Title and/or has failed to take the <br /> action(s) ordered in the notice/order to abate within the time allowed by the notice/order <br /> to abate, Hearing Officer, or Board of Supervisors, then (1) law enforcement agencies or <br /> (2) the Enforcement Official may issue a notice to appear citation to the owner and/or <br /> person in possession or control of the real property. <br /> (b) Infraction_ or Misdemeanor. Every violation of this Title is either an infraction or a <br /> misdemeanor— and regardless of the number of violations of ally section of this Title, <br /> each violation may be charged as either an infi•action or misdemeanor at the discretion of <br /> the District Attorney. afid may be j3utiished by ., fine net e.>ieee ing enehund ed della-fs <br /> htindfed dallafs ($500.00) f;qr- eaeh additional vielalieft ef the same seetion within eiie (4-) <br /> year Each day or portion thereof that the violation exists shall be a new and separate <br /> violation. <br /> (C) Infi•action. If the violation is determined to be an infraction pursuant to subsection (b), <br /> multiple violations of the same section of this Title on the same property shall be <br /> ptuiished as follows: <br /> (1) For the first violation a fine of$100.00 plus any additional penalties assessed by <br /> the Court. <br /> (2) For the second violation of the same section within one (1) year of the first <br /> violation a tine of$200.00, plus any additional penalties assessed by the Court. <br /> (3) For the third and all subsequent violations of the same section within one (1) year <br /> of the first violation a fine of$500.00 plus any additional penalties assessed by <br /> the Court. <br /> (d) Misdemeanor. If the violation is determined to be a misdemeanor pursuant to subsection <br /> (b) the property owner shall be guilty of a misdemeanor and upon conviction thereof <br /> shall be punishable as follows: <br /> (1) By a fine of not more than $500.00; or <br /> (12) By imprisovanent in the County Jail for a term of not more than six (6) months; or <br /> (3) By such fine and/or imprisonment as noted in subsections (d)(1) and (d)(2). <br /> 3 <br />
