Wilson <br /> Chief Counsel <br /> OFFICE OF CHIEF COUNSEL <br /> DATE: April 7, 2004 <br /> SUBJECT: PETITION OF MABEL KEIR FOR REVIEW OF SAN JOAQUIN COUNTY'S <br /> IDENTIFICATION OF RESPONSIBLE PARTIES FOR CORRECTIVE <br /> ACTION AT 1601 TURNPIKE IN STOCKTON, CALIFORNIA: PROPOSED <br /> DENIAL OF STAY REQUEST <br /> SWRCB/DWQ FILE PO4-220 (LOP SITE # 0001525) <br /> BACKGROUND' <br /> The petition in this matter arises from the State Water Resources Control Board's (SWRCB or <br /> State Board) underground storage tank (UST) Local Oversight Program. <br /> The site that is the subject of the petition is located at 1601 Turnpike in Stockton, California. In <br /> 1972, Mr. Bill Snyder, Mr. Mervyn Totman, and Mr. Ralph Smith, general partners of Turnpike <br /> Associates(Turnpike), installed a UST at the site. Turnpike leased the property to R. Goold & <br /> Son, which operated the UST during Turnpike's ownership. On or about April 16, 1986, Mabel <br /> Keir(petitioner) and her husband(now deceased)purchased the property from Turnpike. <br /> Petitioner contends that at the time she purchased the property,the UST was empty and that she <br /> did not use the UST. Petitioner removed the empty UST in January 1987. Contamination has <br /> been discovered at the site, and the San Joaquin County Department of Environmental Health <br /> (the County)has identified petitioner as a responsible party for corrective action. Petitioner <br /> contends that on March 9,2004, the County acted inappropriately when it refused to also name <br /> Turnpike as a responsible party. The County is requiring that petitioner submit a workplan for <br /> the site by April 5, 2004. <br /> ' Because this petition was just recently received,staff has not yet had the opportunity to review the County's <br /> record for this site.
