McCartney Stockton, Ca. 95206 <br /> Ladies/Gentlemen: <br /> I was surprised to receive your letter of 2/20/04, since this matter was concluded in <br /> February, 1997. The small underground tank on this property was removed in 1988 with <br /> your representative present during the removal process. Then, during June, 1996, the <br /> various parties involved in this matter agreed, after meeting with you, to drill test holes as <br /> directed by you, at their expense. The results of these borings were tested by an <br /> independent laboratory approved by you. The test results indicated that no contaminants <br /> were detected. Thereafter, on 2/7/97,your office forwarded a copy of a"case closure <br /> summary" to all the involved parties and indicated that no further action was required. <br /> 1, and the other parties involved in this site through the years, thereafter proceeded in <br /> reliance on your representations made in 1997.
