Monday, with <br /> Damrell Nelson Schrimp Pallios Pacher& Silva Attorneys. EHD also reviewed the Grant <br /> Deed hand delivered by Ms. Monday on February 17, 2004, showing ownership of the <br /> above-referenced property was granted to Duncan B. and Mabel Todd Keir from Turnpike <br /> Associates on April 16, 1986. <br /> In a meeting with Duncan Keir, Bill Snyder, Mervyn Totman, and Ralph Smith, on <br /> February 21, 1995, EHD staff was informed that R. Goold & Son operated the underground <br /> storage tank(UST) and leased the property from Turnpike Associates. The men that formed <br /> the partnership of Turnpike Associates were: E. R. Goold,Ralph Smith,Bill Snyder, and <br /> Mervyn Totman. EHD was told these same men owned R. Goold& Son. <br /> On February 20,2004, EHD sent R. Goold and Son, contact person Bill Snyder, a"Notice of <br /> Responsibility" letter since that company may have been the last operator of the UST. This <br /> is the same letter that EHD sent to you and Nereida Lopez on October 17, 2003. This means <br /> that R. Goold and Son, Ms. Nereida Lopez, and you have each been named as a responsible <br /> party and as such, EHD considers each party equally responsible for assessing and cleaning <br /> up the site at 1601 Turnpike. <br /> The decision not to remove you as a responsible party is based on the following: <br /> • You, as the UST owner,had control of the UST at the time of or following the <br /> unauthorized release of a hazardous substance. <br /> • It is unknown when the unauthorized release occurred. <br /> • There is no documentation to show when the UST was emptied of its contents. <br /> • There is no documentation that the UST was not used between the time you <br /> purchased the property on April 16, 1986, and when the UST was removed on <br /> October 14, 1987. <br />
