This letter is to confirm our recent <br /> communications with regard to our client's request to be removed as a responsible party, <br /> and to add additional responsible parties with regard to the above-referenced property. <br /> On January 26, 2004, I sent you correspondence via facsimile and U.S. Mail <br /> requesting that Mrs. Keir be removed as a responsible party and that Bill Snyder(and <br /> possibly other previous owners and/or operators)be added as responsible parties. The <br /> grounds for our requests are set forth in my previous correspondence. <br /> Subsequently,you responded to my correspondence by telephone and requested <br /> documentation to evidence the fact that Mr. Snyder owned the property prior to the Keirs. <br /> Accordingly, yesterday I hand delivered a copy of the Grant Deed signed April 16, 1986, <br /> wherein ownership of the property was granted to the Keirs from Turnpike Associates, a <br /> partnership. <br /> Bill Snyder's signature appears at the bottom of said Grant Deed as a partner of <br /> Turnpike Associates. The signatures of Ralph M. Smith and Mervyn Totman also appear <br /> at the bottom of said Grant Deed as partners of Turnpike Associates. As these parties are <br /> the persons who actually owned and/or operated the UST at the time it was in use, these <br /> persons are clearly responsible parties. As I indicated in my previous correspondence, <br /> Mr. Snyder has confirmed that at the time ownership of the property was transferred to <br /> the Keirs, the tank was empty and the Keirs never operated the tank. Thus, the Keirs <br /> could not have been responsible for any release <br />
