This letter is to confirm our recent communications with regard to our client's request to be removed as a responsible party, and to add additional responsible parties with regard to the above-referenced property. On January 26, 2004, I sent you correspondence via facsimile and U.S. Mail requesting that Mrs. Keir be removed as a responsible party and that Bill Snyder(and possibly other previous owners and/or operators)be added as responsible parties. The grounds for our requests are set forth in my previous correspondence. Subsequently,you responded to my correspondence by telephone and requested documentation to evidence the fact that Mr. Snyder owned the property prior to the Keirs. Accordingly, yesterday I hand delivered a copy of the Grant Deed signed April 16, 1986, wherein ownership of the property was granted to the Keirs from Turnpike Associates, a partnership. Bill Snyder's signature appears at the bottom of said Grant Deed as a partner of Turnpike Associates. The signatures of Ralph M. Smith and Mervyn Totman also appear at the bottom of said Grant Deed as partners of Turnpike Associates. As these parties are the persons who actually owned and/or operated the UST at the time it was in use, these persons are clearly responsible parties. As I indicated in my previous correspondence, Mr. Snyder has confirmed that at the time ownership of the property was transferred to the Keirs, the tank was empty and the Keirs never operated the tank. Thus, the Keirs could not have been responsible for any release
