Box 144 <br /> Linden, California 95236 <br /> Subject: Lopez Properties <br /> 1601 Turnpike Road <br /> Stockton, California 95206 <br /> Dear Ms. Keir, Ms. Lopez, and the Pensco Trust Company: <br /> By letter dated 29 June 2011, the San Joaquin County Environmental Health Department <br /> (EHD) had approved the installation and operation of a soil vapor extraction (SVE) system and <br /> n in,�- pit�u.� ozone sparging (IOS) pilot study proposed in Corrective Action Plan (CAP), dated <br /> JUr1e12011, by your consulting firm, Advanced GeoEnvironmental, Inc. (AGE) for the <br /> above-referenced site. The EHD's approval was contingent upon approval from the California <br /> Regional Water Quality Control Board Central Valley Region (CRWQCBCVR) of Notice of <br /> Intent to comply with the terms of General Waste Discharge Requirements, and the <br /> Monitoring and Reporting Program No. R5-2008-0149-010. The EHD also directed that the <br /> 16 wells proposed by AGE in the CAP be installed by 01 September 2011. <br /> On 17 June 2011, the EHD posted public notification of pending approval by this department <br /> of the Corrective Action Plan (CAP) to implement remediation at this site and received no <br /> response from the public. <br /> In the most recent annual five-year review summary report from the State Water Resources <br /> Control Board (SWRCB) Cleanup Fund (CUF) dated 18 August 2011, the CUF concurred with <br /> the EHD that "the Responsible Party must begin active remediation without delay to achieve <br /> water quality objectives in a timely manner." <br /> To date, none of the wells has been installed. You are now directed to submit a permit <br /> application and installation/inspection fees to this department and install the wells approved by <br /> the EHD no later than 31 January 2012. This should provide plenty of time to address the <br /> CRWQCBCVR requirements and commence with the IOS pilot test by 17 February 2012, as <br /> well as proceed with the installation and operation of the SVE system by 31 May 2012. <br />
