She said that they found out that <br /> whoever was supposed to submit the cleanup fund application has not done it, so she is working on getting it submitted. <br /> She has had several conversations with the State Cleanup Fund staff(? Barbara). She was told that sometimes it takes 8 <br /> to 9 months for an application to be approved. Her basic question to me was whether or not they can delay implementing <br /> the workplan until they get a letter of commitment. She said they understand that they are still on the hook whether or not <br /> they get approved. In her conversations with Barbara, she was told that sometimes the local agencies will grant RPs an <br /> extension while their application is being processed. The Keir's have apparently been trying to negotiate an assignment to <br /> Mrs. Lopez for the cleanup reimbursement but of course that will not happen until a letter of commitment is issued. <br /> 1 told Judy that you would be back next week and we would need to discuss whether there is any leeway at this time. I will <br /> be in Fresno Monday and Tuesday but will be back in the office on Wednesday. Judy said she has a meeting scheduled <br /> with a consultant(AGE) in Stockton on Friday and would like to meet with you on that day as well if possible. I told her it <br /> would be Tuesday or Wednesday before you could get back to her about Friday. <br /> It sounds like the Cleanup Fund staff at least were consistent with our interpretation of the fact the Keirs are on the hook <br /> as RPs whether or not they operated the tank or still own the property. I am not sure what we have done in the past <br /> regarding sites where RPs are waiting for funding approval and this site has a rather checkered history so 1 do not know <br /> whether we have a valid reason to extend the deadlines.
