Mabel Keir Petition to SWRCB <br /> Page 2 <br /> Based on this new information, the EHD identified the responsible parties as defined in <br /> the Underground Storage Tank (UST) Regulations and, as required by the LOP contract, <br /> "Notice of Responsibility" letters were sent to them on September 30, 2003. Nereida <br /> Lopez was identified because she is the current property owner of record. Mrs. Mabel <br /> Keir was named because she and Mr. Keir (now deceased) were the owners of the <br /> underground storage tank at the time it was permanently closed (ceased to be <br /> operational as defined in UST Regulations Section 2611) and at the time an <br /> unauthorized release was first identified (odor and soil discoloration noted at time of tank <br /> removal). <br /> Subsequent to several communications with Mrs. Keir's attorney, Kathy Monday, and <br /> review of EHD file information including notes from a meeting with Duncan Keir and <br /> principals of Turnpike Associates in 1995, R. Goold & Son, in care of Bill Snyder was <br /> sent a "Notice of Responsibility" letter on February 20, 2004. The men who formed the <br /> corporation stated in a February 1995 meeting that R. Goold & Son leased the property <br /> from Turnpike Associates and operated the tank prior to sale of the property to Mr. Keir. <br /> In addition, State Water Resources Control Board Hazardous Substance Storage <br /> Container Information for San Joaquin County dated October 4, 1985 shows R. Goold & <br /> Son as the owner of the tank and the fee worksheet for the Operating Permit Application <br /> received by EHD on January 31, 1986, indicates R. Goold & Son is the operator(copies <br /> enclosed). <br /> It is not known when the unauthorized release occurred, only that it was discovered <br /> when Mr. and Mrs. Keir were the tank owners. EHD has no information showing that <br /> Turnpike Associates owned or operated the underground storage tank immediately <br /> before the discontinuation of its use at this property, nor any information to show that <br /> Turnpike Associates meets any other definition of a responsible party. The only <br /> information provided to EHD is that Turnpike Associates sold the property to Mr. and <br /> Mrs. Keir.
