hn KLEINFELDER <br /> This proposal/workplan is based on the presumption that the client or owner will clearly <br /> mark utilities and will provide any and all available survey maps or other data to <br /> determine the location of existing structures, underground utilities and services. Danuell, <br /> Nelson, Schrimp, Pallios, Pacher & Silva should be aware that penetrating the site's <br /> surface is inherently risky. It is impossible to determine with certainty the precise <br /> location of all structures, which may be buried in the ground. Kleinfelder's fee is not <br /> adequate to compensate for both the performance of the services and the assumption of <br /> risk of damage to such structures. Disruption of utilities or damage to underground <br /> structures will be the responsibility of the Damrell, Nelson, Schrimp, Pallios, Pacher & <br /> Silva. Services rendered by Kleinfelder to repair them will be billed at cost. <br /> Underground Service Alert (USA) at 1-800-642-2503 provides a partial location service <br /> free of charge for major utility lines. It is important that the Damrell, Nelson, Schrimp, <br /> Pallios, Pacher & Silva understand that subsurface buried under private property will not <br /> be marked by the public utility companies contacted by USA. The drilling company will <br /> make contact with USA for a site visit. <br /> Two copies of each report will be supplied to the client, additional copies will be <br /> provided on a time and expense basis. <br /> SCHEDULE <br /> Kleinfelder can schedule the proposed scope of work within approximately two weeks. The <br /> laboratory analysis will require 10 working days unless a more expedited laboratory turnaround <br /> is requested by the client at an additional charge. Our report will be completed within <br /> approximately ten working days of our receipt of the analytical data. <br /> It should be noted that Kleinfelder has no control over how long it takes for regulatory agencies <br /> to review this or subsequent work plans or ultimately the scheduling of subcontractors. <br /> LIMITATIONS <br /> Kleinfelder prepared this proposal/workplan in accordance with generally accepted standards of <br /> care which exist in San Joaquin County, California at this time. It should be recognized that <br /> definition and evaluation of geologic and environmental conditions are a difficult and inexact <br /> science. Judgments leading to conclusions and recommendations are generally made with <br /> incomplete knowledge of the subsurface conditions present. More extensive studies, including <br /> subsurface investigations, may be performed to reduce uncertainties. If Damrell, Nelson, <br /> Schrimp, Pallios, Pacher & Silva wishes to reduce the uncertainties beyond the level associated <br /> with this proposal/workplan Kleinfelder can be notified for additional consultation. No <br /> warranty, expressed or implied, is made. <br /> Kleinfelder offers various levels of investigative and engineering services to suit the varying <br /> needs of different clients. Although risk can never be eliminated, more-detailed and extensive <br /> investigations yield more information, which may help understand and manage the level of risk. <br /> Since detailed investigation and analysis involves greater expense, our clients participate in <br /> determining levels of service which provide adequate information for their purposes at <br /> 02001PROP.ENV/ST04P347/KS:ss Page 6 of 8 <br /> Copyright 2004,Kleinfelder,Inc.
