The following is an itemized list of hazardous waste violations that have not been addressed for Gonzalez Auto Repair as of April 22, 2020. Open violations from January 15, 2020 inspection Violation#101 -Managed a hazardous waste without an identification number. OBSERVATION: This business does not have an active hazardous waste ID number(CAL000407795)in the California Department of Toxic Substances Control(DTSC)database. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store,dispose of,transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA)Identification (ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than 1 kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to reactivate your State ID number. Immediately reactivate your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#102-Failed to determine if a waste is a hazardous waste. OBSERVATIONS: Guillermo Gonzalez, Owner, stated that he was using rags instead of absorbent to clean oil and was having them laundered by Mission Linen. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. CORRECTIVE ACTION: Immediately cease disposal and make a hazardous waste determination for the rags. Begin to manage the rags according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes.
