AMENDMENT OF WASTE DISCHARGE REQUIREMENTS -3- <br /> RESOLUTION NO. R5-2002-XXX <br /> STOCKTON COGEN COMPANY <br /> SAN JOAQUIN COUNTY <br /> T <br /> 2. Provision F.3 in Order No. 5-01-119 shall be amended to read as follows: <br /> F. Provisions: <br /> 3. Effective 1 November 2003,Receiving Water Limitation E.1 requires that the <br /> discharge not cause receiving water dissolved oxygen to fall below 7.0 mg/l, and <br /> Receiving Water Limitation E.8 requires that the discharge not cause the receiving <br /> water temperature to increase more than 5°F. It is unknown if the Discharger can <br /> comply with these limitations. By 1 July 2003, the Discharger shall submit a report N <br /> providing information to show the discharge can comply with Receiving Water <br /> Limitations E.1 and E.8 or provide a time schedule to achieve compliance with the <br /> limitations. This Order may be reopened to amend the time schedule provided in <br /> Receiving Water Limitation E.1 and/or E.8. The schedule of compliance shall <br /> include a time schedule for completing specific actions that demonstrate reasonable T' <br /> progress toward compliance with the limitations and shall contain a final <br /> compliance date,based on the shortest practicable time required to achieve <br /> compliance. In no event shall the compliance date exceed 10 years from the date of <br /> adoption of this permit. <br /> 3. If, in the opinion of the Executive Officer, the Discharger fails to comply with the provisions of <br /> this order, the Executive Officer may apply to the Attorney General for judicial enforcement or <br /> issue a complaint for Administrative Civil Liability. <br /> I, THOMAS R.
