At the high growth rates present <br /> exceed the present now limit in 2005; at more conservative growth rates,the City will exceed the <br /> flow rate in 2013. hi addition, Order 94-263,Discharge Specification B.1 allows increasing the <br /> monthly average discharge flow to 2.34 million gallons per day based on a submittal of a <br /> technical report. <br /> The Eco:Logic report proposes to reconstruct treatment ponds at depths which will not maintain the <br /> standard five feet of separation between the pond bottom and the highest anticipated groundwater <br /> elevation. A minimum five feet of separation is required by the Board's"Guidelines for Waste Disposal <br /> from Land Developments,"which is referenced in the Fourth Edition Basin Plan for the Sacramento and <br /> San Joaquin River Basins. Construction of the ponds without the minimum five feet of separation may <br /> create a condition of nuisance or pollution as defined by California Water Code Section 13050 and <br /> proceeding with this construction plan may result in adverse impacts to groundwater quality. <br /> Operating the treatment system in such a condition would be in violation of the Standard Provisions and <br /> Reporting Requirements which are part of Order 94-263, and would result in notice of violations, <br /> additional engineering studies, and possible regulatory action.
