"V ti <br /> / ,AD" <br /> ACCESS AGREEMENT ,Li <br /> a� <br /> eTHIS AGREEMENT is made and entered into this — day of May 2001 by and <br /> between Georgia-Pacific Corporation (hereinafter Georgia-Pacific) and Robert Smith and Kathy <br /> Smith (hereinafter "Owners"). the property owners of property located at "Lot 23" on Silkwood <br /> Lane. In Tracy, CA (hereinafter "the Premises"and as indicated on the attached Site Plan "Tracy <br /> Monitoring Well Locations", dated 4/12/2001). <br /> WHEREAS, Georgia-Pacific, its agents, contractors, and their employees, wish to perform certain <br /> abandonment and reinstallation of a monitoring well activities on the Premises. <br /> WHEREAS, the Owners do not object to the performance of such activities by Georgia-Pacific or <br /> its agents or contractors on the Premises. <br /> NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties do <br /> agree as follows: <br /> I. Georgia-Pacific shall mean Georgia-Pacific Corporation, and all of its subsidiaries, <br /> affiliates, officers, directors, shareholders•employees, authorized agents, contractors and their employees. <br /> 2. Owners warrant that they are the owners, in fee simple, of the Premises and have the full <br /> right, power, and authority to execute and enter into this Agreement and grant to Georgia-Pacific the rights <br /> granted to it herein. <br /> 3. The Owners hereby agree to give Georgia-Pacific access to the Premises in the area of.the <br /> West Side Irrigation District's easement for the purposes of abandoning the existing Monitoring Well BC- <br /> I I and reinstallation of a new monitoring well on the Premises as may be required to complete the <br /> construction activities. Such activities may include and involve the use by Georgia-Pacific of heavy <br /> machinery including trucks, drill rigs and some earth-moving equipment. Georgia-Pacific agrees, <br /> whenever possible, to conduct these activities in a manner that does not inconvenience Owners.
