(Musco),its contractors, subcontractors,representatives,and/or agents, together with their personnel and equipment,to enter onto the above referenced real property for the purposes of conducting a limited subsurface investigation to acquire data and information regarding soil and groundwater conditions beneath the property. Percussion is further granted to periodically sample any groundwater monitoring wells developed as a result of the investigation. Activities to be performed on the property include,and are generally limited to, drilling exploration and limited soil and groundwater sampling and analyses. IT IS UNDERSTOOD AND AGREED: 1. The area of work will be left in an orderly condition upon completion of the work and any existing,improvements that may be disturbed or removed during the course of the work will be replaced in kind. Furthermore,all closed gates shall remain closed at all times. Access to the property shall only be allowed from Musco property directly. At all times, fences shall remain effectively in tact for the purposes of retaining any cattle on the property—whether or not cattle are seen in the general area. 2. Existing water well may be sampled but not disturbed in any way that would disrupt the water supply for the cattle. If such disruption occurs, Musco shall keep tank more than half full of good water and water flowing properly into water trough until such time as Musco causes equipment/well to be operational again. 3. The permission to do the work and perform the acts stated herein shall remain in full force and effect until the completion of said exploration and soilsampling and that all rights granted hereunder shall cease whensaid work has beer;. completed. However,Vieira Ranch reserves the right to revoke access after one (1) year from the date this agreement is signed by both parties- Musco Family Olive.Co. agrees to fully indemnify and:to accept full responsibility for claims and suits against the property owner arising from the entry permitted herein with the provisions that the entire handling of such claims and suits is left to us, that we receive the owner's cooperation inthe disposition of such claims and suits, and that the owner does not in any way interfere with our conduct of any investigation,.litigation or:settlement attempt.
