Prior to disclosing the results of the testing to any third party,Licensee <br /> will cause Consultant to issue Consultant's report and data to Licensee and <br /> Licensor. <br /> 4.13. Notices. Any notice provided for herein or otherwise required must be given <br /> by overnight courier or by certified United States mail,postage prepaid, <br /> addressed,to the respective addresses of the Parties as set forth in Section 1.2 <br /> of this Agreement. The person and the place to which notices are to be mailed <br /> may be changed by either Party by notice to the other Party. Notices are <br /> effective as follows:(i)in the case of personal delivery,upon receipt by the <br /> party to whom notice is being given; (ii)in the case of delivery by certified or <br /> registered mail,on the third business day after the notice is sent; or(ii)in the <br /> case of delivery by overnight delivery service,on the business day following <br /> the day the delivery service accepts the notice. <br /> 4.14. Assignment; Successors and Assigns. This Agreement cannot be assigned by <br /> Licensee without the prior written consent of Licensor,which may be withheld <br /> in Licensor's sole, subjective discretion. Subject to the foregoing,this <br /> Agreement is binding upon and inures to the benefit of the Parties'respective <br /> representatives, successors and assigns. <br /> 4.15. Exhibits, Exhibits A,B and C are attached hereto and made a part hereof. <br /> 4.16. Execution Of This Agreement.
