CALIFORNIA REGIONAL WATER QUALITY CONTROI BOARD <br /> CENTRAL VALLEY REGION <br /> ORDER NO. <br /> WASTE DISCHARGE REQUIREMENTS <br /> FOR <br /> MUSCO FAMILY OLIVE COMPANY AND THE STUDLEY COMPANY <br /> WASTEWATER TREATMENT FACILITY <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Reps on, (hereafter Regional Board) <br /> finds that: <br /> 1. Musco Family Olive Company and the Studley Company (hereafter jointly referred to as <br /> "Discharger") submitted a Report of Waste Discharge (RWD), dated 30 April 2002, for land <br /> application of industrial wastewater. Additional information was submitted on 24 June 2002. <br /> 2. Waste Discharge Requirements (WDRs) Order No. 97-037, adopted by the Regional Board on <br /> 28 February 1997,prescribes requirements for Musco Olive Products and the Studley Company. <br /> The RWD was submitted to revise the existing WDRs, and was required due to the increase in the <br /> discharge quantity and quality. The Discharger submitted an R JVD January 2000 which was <br /> deemed incomplete. The resulting enforcement activities that ar-- described below resulted in <br /> submittal of the 30 April 2002 RWD. <br /> 3. The facility is at 17950 Via Nicolo,Tracy,in Section 34, T2S, R4E, and Sections 3 and 4 of T3S, 11 U <br /> R4E,MDB&M, as shown in Attachment A, which is attached hereto and made part of the Order <br /> by reference. The Studley Company owns all of the parcels (Assessor's Parcel Numbers 209-11- <br /> 18, 209-11-31, 209-11-32, 251-32-08, 251-32-09)used for processing and/or land application. <br /> Musco Family Olive Company operates the facility. <br /> 4. Wastewater generated at the facility is regulated by two separate WDRs. Order No. 96-075 <br /> regulates the two surface impoundments regulated under Title 27 of the California Code of <br /> Regulations, §§20005 et seq., (hereafter Title 27) that are used to store concentrated brines. Order <br /> No. 97-037 regulates the less concentrated wastewater which is applied to land. This WDR update <br /> only applies to the less concentrated wastewater. <br /> 5. As set forth in the detailed findings that follow,the Discharger proposes to continue the discharge n /] <br /> of wastes to land, and hence the groundwater,that are herein classified as "designated waste" and \\\`//// <br /> subj ect to full containment under Title 27. However, the discharge of such designated waste to V <br /> land is not allowed under WDRs No. 97-037, and is also not allowed under this updated Order. <br /> The following findings analyze the RWD for requirements under which an exemption from Title <br /> 27 may be granted and, as intended by the RWD, for the conditions under which waste may be <br /> discharged to a land treatment unit, followed by infiltration to groundwater. <br /> z BACKGROUND <br /> 6. Musco Family Olive Company processes approximately one-half the total table olive crop in the <br /> State.
