She stated Young's Ace Hardware maintenance personnel pick them up and may <br /> take them the landfill located on Harney Lane. <br /> REGULATION GUIDANCE: The disposal of any hazardous waste, or the causing thereof, is prohibited when the <br /> disposal is at a facility which does not have a permit from the department issued pursuant to this chapter, or at any <br /> point which is not authorized according to this chapter. Hazardous wastes shall be disposed of only by <br /> transportation to a permitted hazardous waste treatment, storage, and disposal facility(TSDF)or other authorized <br /> point. <br /> CORRECTIVE ACTION: Immediately cease disposal of hazardous waste including fluorescent lamps at the landfill <br /> located on Harney Lane or to the trash and ensure that all future hazardous waste is hauled by a licensed <br /> hazarodus waste transporter to a permitted TSDF. Provide a corrective action statement to the San Joaquin <br /> County Environmental Health Department within 30 days. <br /> This is a Class I violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION:A spill of what appeared to be oily water was observed in the facility warehouse next to a red parts <br /> washer. It was unknown if the spill came from steel drum beneath the parts washer, and if the steel drum was <br /> empty. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean-up the spill and manage the waste, including any waste inside the <br /> steel drum beneath the parts washer, according to Title 22 California Code of Regulations for hazardous waste. <br /> Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department <br /> describing the storage and final disposition of the cleaned up waste. <br /> This is a Class II violation. <br /> FA0022645 PRO539573 SCO01 01/15/2020 <br /> EHD 22-01 Rev.9/20/2019 Page 9 of 13 Small Quantity Hazardous Waste Generator OIR <br /> 1868 E.
