After discussing the concerns with your agent, Mr. Richard <br /> Paulson, he delivered three reports which we had not previously received and <br /> responses to our 5 April 1991 comments. <br /> We have reviewed the following reports and your letter requesting closure <br /> dated 16 January 1991: <br /> Determination of Organic/Inorganic Compounds in Water, 24 August 1989, <br /> 4 Tank Area Closure Report, 7 November 1989, <br /> Groundwater Investigation Report, 5 June 1990, <br /> Soil Remediation Proposal, 31 January 1990 <br /> Laura Scudder had three underground tanks at the site which were removed <br /> between 1987 to 1989. One monitoring well was installed in the Tank No. 2 pit <br /> area to determine if groundwater at 50 feet was impacted. The first sample <br /> was taken in April 1990 and showed low levels of toluene and xylene. The well <br /> was again sampled in May 1990 and the results were all below detection limits <br /> for TPHg, TPHd and BTEX. <br /> The additional information has cleared up some problems, but some items remain <br /> unresolved. However, we have concluded the unresolved items are not signifi- <br /> cant in considering your request to sell the property. <br /> We have discussed this with the San Joaquin County Public Health Services <br /> staff. Board staff has determined that, at this time, no further <br /> investigation, remedial or removal action, or monitoring is required at the <br /> Laura Scudder Property, 100 West Valpico Road, Tracy, San Joaquin County. <br /> Nothing in this determination shall constitute or be construed as a <br /> satisfaction or release from liability for any conditions or claims arising as <br /> a result of past, current, or forure shallebetconstruedthis <br /> to l�mitlthe rights of <br /> this determination is intended out of or relating to deposit or <br /> any parties with respect to claims arising <br />
