r
STATE OF CALIFORNIA—HEALTH AND WELFARE AGENCY GEORGE DEUKMEJIAN, Governor
DEPARTMENT OF HEALTH SERVICES
TOXIC SUBSTANCES CONTROL DIVISION
NORTHERN CALIFORNIA SECTION
4250 POWER INN ROAD
SACRAMENTO,CA 95826
(916)739-3145
March 31, 198
X*
. APR 4198
HSpa
Bruce C. Baracco EN F1E V10ES
SeniorPlanner
San Joaquin County
Department of Planning and
Building Inspection
1810 E. Hazelton Ave.
Stockton, CA 95205
Dear Mr. Baracco:
RESPONSE TO YOUR REQUEST FOR TECHNICAL ASSISTANCE FOR THE TERRA
GENESIS PROJECT
These are the Department's answers to the question posed in your
March 2 , 1988 letter to DHS:
Answer to Question 1
The sample material is classified as hazardous waste by the
Department, any soil contaminated by mixing or spilling a
hazardous substance on or with soil results in hazardous waste.
This is not a matter of policy or interpretation; it is
established by Section 66300 (a) (3) of Title 22 , California Code
of Regulations (CCR) .
Answer to Question 2
No, once the soil is contaminated with hazardous material at any
level, the soil is considered hazardous waste.
Answer to Question 3
The Department has evidence to indicate that soil contaminated to
a level greater than 1000 ppm of total petroleum hydrocarbons
(TPH) may fail the ignitability criteria established in Article
11, Title 22 of the CCR. As such these waste soils should
generally be transported to a hazardous waste facility unless
another adequate method of handling the material is proposed and
approved by the responsible agency. Sites exhibiting lesser
levels of contamination need to be reviewed on a case-by case
basis by the responsible local agency or the Regional Water
Quality Control Board for appropriate site mitigation activity.
