We have reviewed your response dated February 8 ,
1988 , but are not clear as to the appropriate permit requirements
associated with the Terra Genesis project.
San Joaquin County is presently reviewing an application for a
use permit for the Terra Genesis project. Therefore, pursuant
to Section 25199 . 3 (d) of the Health and Safety Code, we hereby
make this request for technical assistance. Specifically, we would
like your input on the following:
1 . Is the sample material submitted to your office by Terra Genesis
on December 16 , 1987 classified as hazardous waste? If not,
what is the proper classification for this material?
2 . Is there any correlation between the degree of contamination
and the classification of saturated material as hazardous or
nonhazardous waste?
3 . At what levels of concentration do soils saturated with petro-
leum hydrocarbon substances become hazardous waste?
4 . Will a hazardous waste treatment facility permit be required
by the Department of Health Services for the Terra Genesis
project irrespective of the contaminant levels?
5 . Are there any measures available to Terra Genesis to qualify
for an exemption or variance from the hazardous waste treat-
ment facility permit requirement?
