UP-88-20 OF PAUL & KAY <br /> GIRDNER (C/O TERRA GENESIS , INC . ) <br /> ---------------------------------------------------------------- <br /> This matter was continued from the Planning Commission hearing of <br /> February 18 , 1988 , in order to permit the applicant to seek a <br /> determination from the State Department of Health Services. Such <br /> a determination would indicate whether or not the proposed pro- <br /> ject is a hazardous waste facility subject to the provisions of <br /> the Tanner Bill (AB 2948) . <br /> After discussing this matter with David Nunenkamp, Chief , State <br /> Office of Permit Assistance, and Keith Riley, Waste Management <br /> Engineer, Toxic Substances Control Division of the State <br /> Department of Health Services, staff is of the opinion that the <br /> Terra Genesis project is a hazardous waste treatment facility. <br /> As such, it would be subject to the provisions of the Tanner <br /> Bill . <br /> It is staff ' s recommendation that the application be withdrawn <br /> and that the applicant file a Notice of Intent with the Office of <br /> Permit Assistance to initiate the Tanner process. <br /> CD/BB/blm <br />
