E. Severability <br /> The provisions of this permit are severable , and if any <br /> provision of this permit or the application of any provision of <br /> this permit to any circumstance is held invalid, the <br /> application of such provision to other circumstances and the <br /> remainder of this permit shall not be affected thereby. <br /> F. Operation Plan <br /> 1. By the issuance of the permit, the Operation Plan dated <br /> March 6, 1990 is hereby approved. This Operation Plan <br /> and any subsequent revisions thereof, subject to the <br /> approval of the Department, are by this reference made <br /> part of this permit. Specific sections of this Operation <br /> Plan are referenced elsewhere in this permit. <br /> 2. The owner or operator shall operate and maintain the <br /> facility in accordance with the Operation Plan. <br /> 3. In the event of any conflict between this permit and the <br /> Operation Plan referenced herein, the provisions of the <br /> permit shall be controlling. <br /> 4. The Operation Plan shall be maintained at the facility at <br /> all times until closure is completed. <br /> G. General Responsibilities of Operator <br /> 1. Compliance <br /> a. The owner or operator shall comply with all <br /> conditions of this permit, except to the extent and <br /> for the duration such noncompliance is authorized <br /> by an emergency permit or approved by the <br /> Department. Any permit noncompliance constitutes <br /> grounds for enforcement action, permit termination, <br /> revocation and reissuance, modification or for <br /> denial of a permit renewal application. <br /> b. The owner or operator shall comply with all laws, <br /> regulations, permits, zoning conditions and all <br /> other requirements established by federal, state <br /> and local agencies. <br /> 2. Reapplication <br /> If the owner or operator wishes to continue an activity <br /> regulated by this permit after the expiration date of <br /> this permit , the owner or operator must submit a <br /> completed application for a new permit at least 180 days <br /> before this permit expires. <br /> -3- <br />
