"I hereby certify under penalty of law, that <br /> personnel under my direction and supervision at <br /> this facility are undertaking specific steps in <br /> accordance with a program in place, to minimize the <br /> amount and toxicity of hazardous wastes generated <br /> at this facility to a degree economically <br /> practicable and that the method utilized for the <br /> treatment, storage or disposal of hazardous wastes <br /> is the most practicable method currently available <br /> to this facility which minimizes the present and <br /> future threat to human health and the environment. <br /> I am aware that there is significant penalties for <br /> false certification, including the possibility of <br /> fine and .imprisonment for flagrant falsifications. " <br /> The Permittee shall make this certification at least annually. <br /> [40 CFR 264.73(b) (9) ] <br /> H. RESPONSIBILITIES AND REQUIREMENTS <br /> 1. Duty to Comply <br /> The Permittee shall comply with all conditions of this Permit, <br /> except to the extent and for the duration such noncompliance is <br /> authorized by an emergency permit. Any Permit noncompliance, <br /> except under the terms of an emergency permit, constitutes a <br /> violation of RCRA and is grounds for enforcement action, Permit <br /> termination, revocation and reissuance, modification, or denial <br /> of a permit renewal application. [40 CFR 270 . 30 (x) and <br /> 270.51(c) ] <br /> 2. Duty to Reapply <br /> If the Permittee wishes to continue an activity regulated by this <br /> Permit after the expiration date of this Permit, the Permittee <br /> shall apply for and obtain a new Permit. Such application must <br /> be submitted to the Director at least one hundred and eighty <br /> (180) calendar days before this Permit expires and shall include <br /> all information set forth in 40 CFR 270.13, 270.14, 270.15 and <br /> 270.16. If this Permit is modified before it expires to include <br /> surface impoundments, waste piles, incinerators, land treatment <br /> units, or landfills, miscellaneous units or other hazardous waste <br /> management units which may be regulated by 40 CFR 264 in the <br /> future, the Permittee shall also provide information set forth in <br /> 40 CFR 270 .17 , 270 . 18 , 270 . 19, 270 .20 , 270 . 21 and 270 . 23 <br /> respectively. The Permittee shall keep records of all data used <br /> to complete Permit applications and any supplemental information <br /> for a period of at least three years from the date the Permittee <br /> signs the application.
