(5) A description of the nature and extent of any actual and potential endangerments. The Permittee need not comply with the five (5) calendar days written notice requirement if the Director waives the requirement and the Permittee submits a written report within fifteen (15 ) calendar days from the time the Permittee becomes aware of the circumstances . [40 CFR 270.30(1) (6) ] 13. Other Noncompliance The Permittee shall report all other instances of noncompliance, not otherwise required to be reported in Permit conditions II.H.10 and II.H.12. The reports shall contain the information listed in Permit condition II.H.12. [40 CFR 270.30(1) (10) ] 14. Other Information Whenever the Permittee becomes aware that it failed to submit any relevant facts in the Permit application, or submitted incorrect information in a Permit application or in any report to the Director, the Permittee shall promptly submit such facts or information to the Director. For the purpose of this condition only, "promptly" means no later than thirty (30) calendar days from the time the Permittee becomes aware of the circumstances. [40 CFR 270.30(1) (11) ] 15. Transfer of Permits a. This Permit is not transferable to any person except after notice to the Director. [40 CFR 270.30(1) (3)] b. This Permit may be transferred by the Permittee to a new owner or operator only if the Permit has been modified or revoked and reissued under 40 CFR 270 . 40 (b) or 40 CFR 270.41(b) (2) to identify the new Permittee and incorporate such other requirements as may be necessary under RCRA. [40 CFR 270.40, 270.41 and 270.42] c. Before transferring ownership or operation of the facility during its operating life, the Permittee shall notify the new owner or operator in writing of the requirements of 40 CFR 264 and 40 CFR 270. A copy of this notification shall be submitted to the Director. [40 CFR 264.12(c) ] I. CONFIDENTIAL INFORMATION 1. In accordance with 40 CFR Part 2, any information submitted to the Director pursuant to this Permit may be claimed as confidential by the Permittee. Any such claim may be asserted at the time of submission in the manner prescribed on the application form or instruction or, in the case of other submissions , by stamping the words "Confidential Business II.8
