(5) A description of the nature and extent of any actual <br /> and potential endangerments. <br /> The Permittee need not comply with the five (5) calendar <br /> days written notice requirement if the Director waives the <br /> requirement and the Permittee submits a written report <br /> within fifteen (15 ) calendar days from the time the <br /> Permittee becomes aware of the circumstances . [40 CFR <br /> 270.30(1) (6) ] <br /> 13. Other Noncompliance <br /> The Permittee shall report all other instances of noncompliance, <br /> not otherwise required to be reported in Permit conditions <br /> II.H.10 and II.H.12. The reports shall contain the information <br /> listed in Permit condition II.H.12. [40 CFR 270.30(1) (10) ] <br /> 14. Other Information <br /> Whenever the Permittee becomes aware that it failed to submit any <br /> relevant facts in the Permit application, or submitted incorrect <br /> information in a Permit application or in any report to the <br /> Director, the Permittee shall promptly submit such facts or <br /> information to the Director. For the purpose of this condition <br /> only, "promptly" means no later than thirty (30) calendar days <br /> from the time the Permittee becomes aware of the circumstances. <br /> [40 CFR 270.30(1) (11) ] <br /> 15. Transfer of Permits <br /> a. This Permit is not transferable to any person except after <br /> notice to the Director. [40 CFR 270.30(1) (3)] <br /> b. This Permit may be transferred by the Permittee to a new <br /> owner or operator only if the Permit has been modified or <br /> revoked and reissued under 40 CFR 270 . 40 (b) or 40 CFR <br /> 270.41(b) (2) to identify the new Permittee and incorporate <br /> such other requirements as may be necessary under RCRA. <br /> [40 CFR 270.40, 270.41 and 270.42] <br /> c. Before transferring ownership or operation of the facility <br /> during its operating life, the Permittee shall notify the <br /> new owner or operator in writing of the requirements of <br /> 40 CFR 264 and 40 CFR 270. A copy of this notification <br /> shall be submitted to the Director. [40 CFR 264.12(c) ] <br /> I. CONFIDENTIAL INFORMATION <br /> 1. In accordance with 40 CFR Part 2, any information submitted to <br /> the Director pursuant to this Permit may be claimed as <br /> confidential by the Permittee. Any such claim may be asserted at <br /> the time of submission in the manner prescribed on the <br /> application form or instruction or, in the case of other <br /> submissions , by stamping the words "Confidential Business <br /> II.8 <br />
