r 2. Testing and Maintenance of Equipment The Permittee shall test and maintain all facility communications or alarm systems , fire protection equipment, spill control equipment and decontamination equipment as necessary to ensure its proper operation in time of emergency at the facility. Access to Communications or Alarm System The Permittee shall maintain access to the communications or alarm systems specified in Section X.A of the Part B Application, as required by 40 CFR 264.34. Required Aisle Space The Permittee shall maintain aisle space as needed to allow the unobstructed movement of personnel, fire protection equipment, spill control equipment and decontamination equipment as required by 40 CFR 264.35. [40 CFR 264.35] 5. Arrangement with Local Authorities a. The Permittee shall ensure that emergency response arrangements with local authorities given in Section X.A of the Part B Application, as required by 40 CFR 264.37(a) , are updated annually. [40 CFR 264.37(a) ] b. If local authorities refuse to enter into preparedness and prevention arrangements with the Permittee, the Permittee shall document this refusal in the operating record. [40 CFR 264.37(B) ] H. CONTINGENCY PLAN 1. Implementation Whenever there is a fire, explosion, or release of hazardous waste or constituents which threatens or could threaten human health or the environment, the emergency coordinator or his designee shall immediately carry out the provisions of the Contingency Plan as described in Section X of the Part B Application and as required by 40 CFR 264.56.
