to the date of the transfer. Furthermore, before <br /> transferring ownership or operation of the facility during <br /> its operating life, the owner or operator shall notify the <br /> new owner or operator in writing of the requirements of <br /> this permit and the permitting process. A copy of this <br /> notification shall be submitted to the Department. <br /> 5. Mitigation <br /> The owner or operator shall take all reasonable steps to <br /> minimize or correct any adverse impact on the environment <br /> resulting from noncompliance with this permit. <br /> 6. Operation and Maintenance <br /> a. The facility shall be maintained at all times and <br /> operated to minimize the possibility of a fire, <br /> explosion, or any unplanned sudden or nonsudden <br /> release of hazardous , waste or hazardous waste <br /> constituents to air, soil, surface water, or ground <br /> water which could threaten human health or the <br /> environment. <br /> b. All equipment, pipes, and lines used at the facility <br /> to handle, transfer, pump, or store hazardous wastes <br /> shall be maintained in a manner that prevents the <br /> leaking and spilling of hazardous wastes. <br /> C. The owner or operator shall at all times properly <br /> operate and maintain all facilities of treatment and <br /> control (and related appurtenances) which are <br /> installed or used by the owner or operator to achieve <br /> compliance with the conditions of this permit. Proper <br /> operation and maintenance includes effective <br /> performance, adequate funding, adequate staffing and <br /> training of personnel, and adequate laboratory and <br /> process controls, including appropriate quality <br /> assurance procedures. This provision requires the <br /> operation of back-up or auxiliary facility or similar <br /> systems only when necessary to achieve compliance with <br /> the conditions of the permit. <br /> 7. Submittal of Requested Information <br /> The owner or operator shall furnish to the Department, <br /> within a reasonable time, any relevant information which <br /> the Department may request to determine whether cause <br /> exists for modifying, revoking and reissuing, terminating <br /> this permit, or to determine compliance with this permit. <br /> The owner or operator shall also furnish to the Department; <br /> upon request, copies of records required to be kept by this <br /> permit. <br /> -4- <br />
