IV. COMPLIANCE SCHEDULE
Reports of compliance or noncompliance with Building 609 closure plan
schedule, approved by the Department, shall be submitted to the
Department no later than 14 days following each scheduled date.
V. CORRECTIVE ACTION FOR RELEASES OF HAZARDOUS WASTE
A. Background
Pursuant to Section 3004 (u) of the Hazardous and Solid Waste
Amendment of 1984 (Resource Conservation and Recovery Act (RCRA)
reauthorization) , a permit issued after November 8; 1984 must
require corrective action for all releases of hazardous waste or
constituents from any solid waste management unit at a
treatment, storage, or disposal facility seeking an RCRA permit.
Permits issued must contain schedules of compliance for the
corrective action. In addition, Section 3004 (v) requires that
corrective action be taken beyond the boundary of hazardous
waste facilities unless the owner or operator can demonstrate
that permission to undertake this action is not obtainable.
B. Site Specific Considerations
Nav Comm has disposed, on site, unknown quantities of hazardous
waste. The most notable activities with respect to potential
contamination were stemming from disposal of wastes generated
during routine functions. In order to fully identify the nature
and extent of soil and water contamination and protect the
public health and safety from these disposal practices, a
corrective action agreement between Nav Comm, EPA, and the State
of California must be reached. The agreement will include, but
not be limited to, the following areas:
1. Landfill area and burning ground on the west side of the
island;
2. Battery acid disposal area;
3. Fire fighting area;
4. GSA damaged container storage area; and
5. Two-thousand-gallon used oil tank located adjacent to
Building 816-C.
C. Requirements
1. Upon execution of an agreement between Nav Comm, EPA, and
the State of California, Nav Comm shall implement all
corrective action in accordance with time schedules
contained in the agreement.
2. In the absence of execution of an agreement, Nav Comm shall
implement all corrective action in accordance with the time
-21-
