IV. COMPLIANCE SCHEDULE <br /> Reports of compliance or noncompliance with Building 609 closure plan <br /> schedule, approved by the Department, shall be submitted to the <br /> Department no later than 14 days following each scheduled date. <br /> V. CORRECTIVE ACTION FOR RELEASES OF HAZARDOUS WASTE <br /> A. Background <br /> Pursuant to Section 3004 (u) of the Hazardous and Solid Waste <br /> Amendment of 1984 (Resource Conservation and Recovery Act (RCRA) <br /> reauthorization) , a permit issued after November 8; 1984 must <br /> require corrective action for all releases of hazardous waste or <br /> constituents from any solid waste management unit at a <br /> treatment, storage, or disposal facility seeking an RCRA permit. <br /> Permits issued must contain schedules of compliance for the <br /> corrective action. In addition, Section 3004 (v) requires that <br /> corrective action be taken beyond the boundary of hazardous <br /> waste facilities unless the owner or operator can demonstrate <br /> that permission to undertake this action is not obtainable. <br /> B. Site Specific Considerations <br /> Nav Comm has disposed, on site, unknown quantities of hazardous <br /> waste. The most notable activities with respect to potential <br /> contamination were stemming from disposal of wastes generated <br /> during routine functions. In order to fully identify the nature <br /> and extent of soil and water contamination and protect the <br /> public health and safety from these disposal practices, a <br /> corrective action agreement between Nav Comm, EPA, and the State <br /> of California must be reached. The agreement will include, but <br /> not be limited to, the following areas: <br /> 1. Landfill area and burning ground on the west side of the <br /> island; <br /> 2. Battery acid disposal area; <br /> 3. Fire fighting area; <br /> 4. GSA damaged container storage area; and <br /> 5. Two-thousand-gallon used oil tank located adjacent to <br /> Building 816-C. <br /> C. Requirements <br /> 1. Upon execution of an agreement between Nav Comm, EPA, and <br /> the State of California, Nav Comm shall implement all <br /> corrective action in accordance with time schedules <br /> contained in the agreement. <br /> 2. In the absence of execution of an agreement, Nav Comm shall <br /> implement all corrective action in accordance with the time <br /> -21- <br />
