This is a violation of CCR Section 66266.130(c) (c) In accordance with subsection (a) of this section, used <br />oil filters that meet the conditions of subsection (b) of this section and are managed and recycled in <br />compliance with the following requirements shall not be regulated as hazardous waste. <br />(1) The filters are drained of five -flowing used oil. For the purposes of this subsection, free-flowing is <br />defined as a continuous stream of oil exiting the filter when the filter is inverted. Oil exiting drop by drop <br />is not considered to be fire flowing. However, if the filter is equipped with a device (such as a rubber flap <br />located just inside the filter opening) which impedes the drainage of used oil from the filter, that device <br />shall be manipulated to allow the oil to exit the filter freely, or the filter punctured, crushed, opened, <br />drained, or otherwise handled in a manner that will allow the used oil to exit the filter - <br />Drain filters of fi-ee flowing oil before storing it. Begin practice immediately. <br />Violation # 43) No contingency plan. <br />Facility failed to have a contingency plan. <br />This is a violation of CCR Section 66265.51 Purpose and Implementation of Contingency Plan <br />(a) Each owner or operator shall have a contingency plan for the facility. The contingency plan shall be <br />designed to minimize hazards to human health or the environment from fires, explosions, or any <br />unplanned sudden or non -sudden release of hazardous waste or hazardous waste constituents to air, soil, or <br />surface water <br />(b) The provisions of the plan shall be carried out immediately whenever there is a fire, explosion, or <br />release of hazardous waste or hazardous waste constituents which could threaten human health or the <br />environment <br />ite for records. <br />Violation # 49) Personnel training records Incomplete <br />�4 I; I I JJMTMJ��� <br />This is a violation of CCR Section s 66265.16. Personnel Training. <br />(a)(1) Facility personnel shall successfully complete a program of classroom instruction or on-the-job <br />VM- -"5& M <br />I-124 -to J.-Ar.Mr*9k AWizw.-? -x <br />requirements of this chapter. The owner or operator shall ensure that this program includes all the <br />elements described in the document required under subsection (d)(3) of this section. <br />(2) This program shall be directed by a person trained in hazardous waste management procedures, ant <br />shall include instruction which teaches facility personnel hazardous waste management procedures <br />(including contingency plan unplementation) relevant to the positions in which they am employed. <br />(3) At a minimum, the training program shall be designed to ensure that facility personnel are able to <br />respond effectively to emergencies by fiumharizmg them with emergency procedures, emergency <br />equipment, and emergency systems, including where applicable: <br />(A) Procedures for using, 111SPOCting, repairing, and replacing facty emergency and monitoring <br />equipment; <br />(B) Key parameters for automatic waste feed cut-off systems; <br />(C) Communications or alarm systems; <br />(D) Response to fires or explosions; <br />(E) Response to #.11 1: contamination incidents; and <br />(F) Shutdown of operations. <br />
