Immediately stop disposing of brake shavings as non-hazardous waste and <br /> make a hazardous waste determination for the braking shavings and manage it according the Title 22 hazardous <br /> waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. <br /> This is a repeat violation,Class II. <br /> Page <br /> Safety Kleen has provided the profile on Brake Shavings as a Non-Regulated Waste.The profile is <br /> attached for review. <br /> 108 CCR 66265.52 Contingency plan is incomplete. <br /> The facility's contingency plan is incomplete.An emergency coordinator was not listed in the contingency plan.The <br /> contingency plan must include: <br /> 1. Description of actions facility personnel will take in response to fires,explosions,or any sudden or <br /> non-sudden release of hazardous waste to air,soil or surface water at the facility; <br /> 2. Description of arrangements made with local police departments,fire departments,hospitals,contractors and <br /> State and local emergency response teams to coordinate emergency services; <br /> 3. List of names, addresses,and phone numbers(office/home/cell)of all persons qualified to act as emergency <br /> coordinator.Where more than one person is listed,one shall be named as the primary emergency coordinator and <br /> all others in order in which they will assume responsibilities; <br /> 4. List all emergency equipment,which includes location, physical description,and brief 6utline of its capabilities; <br /> 5. Evacuation routes for facility personnel where there is a possibility of evacuation; <br /> 6.Current telephone number for State Office of Emergency Services. <br /> If the facility has a Spill Prevention,Control and Countermeasures plan,or some other emergency or contingency <br /> plan,the owner or operator need only amend that plan to incorporate hazardous waste management provisions that <br /> are sufficient to comply with the requirements of this chapter. Immediately prepare or amend an existing plan to <br /> fulfill the requirements of this chapter.Submit a copy of the contingency plan to the EHD. <br /> The newer Contingency Plan has been submitted to CERA which now states that Jimmy Spears (Store <br /> Manager)is the Emergency Coordinator.The Contingency plan that had originally been submitted and <br /> accepted was deemed out of date per inspector.The form that was provided by the inspector has been <br /> completed as stated above. <br /> 114 CCR 66262.40(a)Failed to keep signed copy of manifests from the designated facility for three years. <br /> Manifest number 005388283JJK from August 24,2016 was found without a signed off copy from the destination <br /> facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site <br /> for three years and have them readily available for review. If the generator did not receive a copy of the manifest <br /> with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted <br /> within 60 days of the date the waste was accepted by the initial transporter,the generator shall submit a legible copy <br /> of the missing manifest,with some indication that the generator has not received confirmation of delivery.This <br /> information shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento,CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit the required information to DTSC. <br /> Submit to the EHD a copy of the signed off copy of the manifest or a copy of the information submitted to DTSC. <br /> The copy of the signed manifest(005388283JJK) has been located and is attached. <br />
