0 0 <br /> Forward Landfill <br /> San Joaquin County -2- 16 May 2017 <br /> model failed to account for the fact that the landfill has an ongoing VOC release which indicates <br /> that the liner integrity may be compromised and therefore there is a potential for a release of <br /> hazardous waste as well. <br /> As of the date of this Order, hazardous waste remains in place in violation of WDRS Order <br /> R5-2014-0006 and the Discharger has yet to obtain a variance from DTSC for the hazardous <br /> material to remain in the Class 11 lined units. To determine the impacts, if any the Discharger <br /> shall provide results from enhanced monitoring for pH and dissolved inorganics/metals from <br /> specific sampling locations, <br /> Water Code Section 13267 Request for Technical Reports <br /> Section 13267 of the California Water Code states, in part: <br /> In conducting an investigation specified in subdivision (a), the regional board may require that <br /> any person who has discharged, discharges, or is suspected of having discharged or <br /> discharging - or any citizen or domicifiary, or political agency or entity of this state who has <br /> discharged, discharges, or is suspected of having discharged or discharging... waste outside of <br /> its region that could affect the quality of waters within its region shall furnish, under penalty of <br /> peilury, technical or monitoring program reports which the regional board requires. The burden, <br /> including costs, of these reports shall bear a reasonable relationship to the need for the report <br /> and the benefits to be obtained from the reports. In requiring those reports, the regional board <br /> shall provide the person with a written explanation with regard to the need for the reports, and <br /> shall identify the evidence that supports requiring that person to provide the reports. <br /> Section 13268 of the California Water Code states, in part: <br /> (a)Any person failing or refusing to furnish technical or monitoring program <br /> reports as required by subdivision (b)of Section 13267...or falsifying and <br /> information provided therein, is guilty of a misdemeanor and may be liable civilly <br /> in accordance with subdivision(b), <br /> (b)(1) Civil liability may be administratively imposed by a regional board in <br /> accordance with Article 2.5(commencing with section 13323) of Chapter 5 for a <br /> violation of subdivision (a)in an amount which shall not exceed one thousand <br /> dollars ($1,000) for each day in which the violation occurs. <br /> Republic Services Inc., failure to comply with the WDRs has resulted in impacts, or threatened <br /> impacts, to water quality. In order to ensure that staff has sufficient information to determine the <br /> potential impact from the hazardous waste, whether corrective actions and/or further <br /> enforcement action is appropriate, and to ensure compliance with applicable laws and <br /> regulations, the Forward Landfill is hereby directed to submit the following reports. This request <br /> is made pursuant to Section 13267 of the California Water Code. Republic Services Inc., owns <br /> and operates the landfill cited herein and is responsible for all waste generated at the facility. <br /> Republic Services Inc. is hereby required to submit the following technical reports by the listed <br /> dates: <br />
