R
No. 20- Failed to completely label containers or tanks of hazardous waste. (CCR 66262.34(f))
Hazardous waste accumulation stickers must be placed on any aboveground storage containers
(either drums or tanks) that hold waste antifreeze, wastewater, waste oil or oil filters. Pep
Boys policy and procedures provide instructions to complete the hazardous waste accumulation
sticker. A new label must be affixed to containers each time the waste has been removed. The
November 4, 2010 inspection report required a licensed hauler to dispose of the waste, and
submit copies of the manifest to the EHD. Attachment A contains copies of the November 26,
2010, December 4, 2010 and December 17, 2010 manifests for the waste brake fluid, waste
water and waste antifreeze removal after the inspection date.
No. 32 - Failed to comply with new HW tank system assessment requirements. (CCR
66265.192)
It is believed the used oil tank was inspected by the local Fire Department prior to being
installed. In addition, filing an exemption under 22CCR 66265.192(j) was investigated. A
Hazardous Waste Tank System Assessment for Store #711 was performed by a California
professional engineer in February 2012. A copy was sent to the store and is included in the July
17, 2013 inspection report.
No. 35 -Failed to conduct daily inspections of HW tank. (CCR 66265.195(a))
To comply with California state regulations, Pep Boys Store #711 maintains a Hazardous Waste
Tank System Daily Inspection Log, which is stored in the green environmental binder. Given the
time that has expired between this inspection report and the November 4, 2010 inspection, the
daily inspection forms from 2010 could not be located.
No.44—Failed to: (a) prepare a contingency plan; (b) implement contingency plan. (CCR
66265.51)
A Hazardous Materials Management Plan/Inventory Certification Statement was submitted on-
line on April 23, 2010. An additional copy was submitted to the store to insert into their green
environmental binder.
- Attachment B is a copy of the April 23, 2010 plan
- Attachment C is a copy of Pep Boys policy on responding to spills.
Pep Boys is serious about it's commitment to the environment. Please do not hesitate to
contact me if you have any questions or concerns regarding this information at 215-430-9530
or e-mail at keith_graver@pepboys.com.
Sincerely,
Keith Graver
Environmental Manager
The Pep Boys—Manny, Moe &Jack
3111 West Allegheny Avenue l Philadelphia, PA 19132
215.430.9530(phone) / 215.430.4639(fax)
