Box 1728 <br /> Stockton, CA 95201 <br /> Dear Mr. Fegley: <br /> NOTICE OF VIOLATION AND ORDER FOR COMPLIANCE <br /> On April 5, 1985 the Department conducted an inspection of McCormick and <br /> Baxter Creosoting Company CAD009106527 located in Stockton, California. <br /> As a result of that inspection, a number of violations of hazardous waste <br /> statutes , regulations, permits , and directives were identified. <br /> Specific violations and required corrective action are listed below. Failure <br /> to correct the identified problems within the time frames provided will result <br /> in the Department taking enforcement action as provided by law. <br /> I . Schedule of Violations <br /> Hazardous Waste Faci I IiLy Permit Violations No. CAD009106527 <br /> . h 3i <br /> 1 . Section 11 . - McCormick and Baxter failed to include the <br /> date, exact place and time• of sampling on all monitoring records. <br /> 2. Section 11 .6. (h) (3) (ii )- McCormick and Baxter Failed to include the <br /> individual_(swho per orried the sampling on all monitoring records. <br /> 3. Section 11 .6. (h) (3) (v)- McCormick and Baxter failed to include the <br /> analytical techniques or methods used on all monitoring records. <br /> 4. Section 11 . 10. (c) (1) (ii)- +`icCormiCk and Baxter failed to cross- <br /> reference the location and quanity of each hazardous waste within <br /> the facility to specific manifest document numbers. <br /> 5. Section ill .8. (e) (1)- McCormick and Baxter failed to include the <br /> names of all the employees filling each job related to hazardous <br /> waste management in the personnel records. <br /> II . Schedule for Correction <br /> All the violations listed .under the Schedule of Violations shall be <br /> corrected immediately upon receipt of this order. A letter certifying <br /> that the violations have been corrected shall be submitted to this office <br /> by June 1 , 1985. <br />
