Statement of Facts, McCormick & Baxter -2- <br /> Alleged, Violations <br /> A. Health & Safety Code, Division 201 Chapter 6.5 <br /> 1. Section 25142 - McCormick & Baxter failed to handle and dispose of <br /> hazardous wastes pursuant to all permits and regulations issued by <br /> the Department. <br /> 2. Section 25154 - McCormick & Baxter unlawfully handled and disposed <br /> of hazardous waste within the meaning of Section 25113. <br /> 3. Section 25189.5 - McCormick & Baxter unlawfully disposed of hazardous <br /> wastes at a point not permitted by the Department. <br /> 4. Section 25201 - McCormick & Baxter unlawfully operated a disposal <br /> .facility without a permit from the Department <br /> B. California Administrative Code, Title 22, Division 4, Chapter 30 <br /> 1. Sections 66370 & 66373 - McCormick & Baxter failed to apply for and <br /> obtain a Hazardous Waste Facility Permit prior to establishing, <br /> operating, and maintaining a hazardous waste facility. <br /> 2. Section 66490(a) - McCormick & Baxter unlawfully disposed of hazardous <br /> waste at an-d-Hauthorized, nonpermitted site. <br /> 3. Section 66505(c) - McCormick & Baxter failed to ensure that hazardous <br /> .waste was taken to a permitted facility. <br /> 4. Section 66525(a) - McCormick & Baxter failed to design, equip, and <br /> operate their facility to prevent discharge of hazardous wastes outside <br /> designated areas and prevent hazards to public health, personal safety, <br /> wildlife, and domestic stock. <br /> 5. Section 66530(a) - McCormick & Baxter failed to dispose of hazardous <br /> wastes and operate their facility in accordance-with regulations <br /> 66530(e) - McCormick & Baxter failed to use methods to ensure <br /> that hazardous wastes were not discharged or moved outside of designated <br /> areas; failed to prevent contamination or exposure of people; . and failed <br /> to avoid operating hazards to public health and safety, wildlife or do- <br /> mestic stock. ­; <br /> 66530( j) - McCormick & Baxter failed to expeditiously collect <br /> hazardous wastes accidentally discharged and contaminated soils resulting <br /> from such discharge. <br />
