McCORMICK AND BAXTER CREOSOTING COMPANY <br /> SAN JOAQUIN COUNTY <br /> F. Provisions: <br /> 1. Neither the discharge nor its treatment shall create a nuisance as defined <br /> in the California Water Code. <br /> 2. McCormick and Baxter Creosoting Company shall comply with the following time <br /> schedule to assure compliance with Limitations C.1, C.2, E.2, and E.3 of this <br /> Order: <br /> Compliance Report of <br /> Task Date Compliance Due <br /> Develop Work Plan 10-1-74 10-15-74 <br /> Develop Conceptual Plan 1-3-75 1-15-75 <br /> Complete Final Construction Plans 4-1-75 4-15-75 <br /> Progress Report 9-1-75 9-15-75 <br /> Progress Report 2-1-76 2-15-76 <br /> Complete Construction 8-1-76 8-15-76 <br /> Full Compliance 10-1-76 10-15-76 <br /> The McCormick and Baxter Creosoting Company shall submit to the Board on or <br /> before each compliance report date, a report detailing his compliance or <br /> noncompliance with the specific schedule date and task. <br /> If noncompliance is being reported, the reasons for such noncompliance <br /> shall be stated, plus an estimate of the date when the discharger will be <br /> in compliance. The discharger shall notify the Board by letter when he has <br /> returned to compliance with the time schedule. <br /> 3. The requirements prescribed by this Order supersede the requirements prescribed <br /> by Resolution No. 65-44 adopted by the Board on 23 April 1965, which is hereby <br /> rescinded. <br /> 4. This Order includes items 1, 3, 5, 6, and 7 of the attached "Reporting Re- <br /> quirements". <br /> 5. This Order includes items 1, 2, and 4 through 11 of the attached "Standard <br /> Provisions". <br /> 6. The discharger shall comply with the Monitoring and Reporting Program <br /> No. 74-407 and the General Provisions for Monitoring and Reporting <br /> as specified by the Executive Officer. <br /> - 5 <br />
