This Order shall serve as a National Pollutant Discharge Elimination System per- <br /> mit pursuant to Section 402 of the Federal Water Pollution Control Act, or amend- <br /> ments thereto, and shall take effect at the end of ten days from the date of the <br /> hearing provided the Regional Administrator has no objections. <br /> IT IS HEREBY ORDERED, McCormick and Baxter Creosoting Company, in order to meet the <br /> provisions contained in Division 7 of the California Water Code and regulations adopted <br /> thereunder and the provisions of the Federal Water Pollution Control Act, and regula- <br /> tions and guidelines adopted thereunder shall comply with the following: <br /> A. The discharge shall not have a pH less than 6.5 nor greater than 8.5. <br /> 3. The maximum daily dry weather discharge shall not exceed 255,000 gallons, <br /> 4. The discharger shall use the best practicable cost effective control technique <br /> currently available to limit mineralization to no more than a reasonable in- <br /> crement. <br /> 5. The maximum temperature of the discharge shall not exceed the ambient temper- <br /> ature of Mormon Slough by more than 20*F. <br /> 2 <br />
