Failing to secure the payment of compensation insurance, in violation of Labor <br /> 7 Code section 3700.5; <br /> 8 d. Failing to withhold, or failed to pay over any tax withheld,with or without intent to <br /> 9 evade, in violation of Unemployment Insurance Code section 2118; <br /> to v. Failing to report immediately by telephone or telegraph to the nearest District <br /> I I Office of the Division of Occupational Safety and Health any serious injury or illness,or death, of an <br /> 12 employee,in violation of California Code of Regulations,title 8 section 342; <br /> 13 f, Failing to implement and maintain an effective Injury and Illness Prevention <br /> 14 Program,in violation of California Code of Regulations,title 8 section 3203; <br /> 15 g. Failing to develop, implement,and maintain at the workplace a written hazard <br /> 16 communication program for their employees, in violation of California Code of Regulations,title 8 <br /> 17 section 5194(e)(1); <br /> 18 h. Failing to have a material safety data sheet for each hazardous substance they use, <br /> 19 in violation of California Code of Regulations,title 8 section 5194(g)(1); <br /> 20 i. Failing to provide employees with effective information and training on hazardous <br /> 21 substances in their work are at the time of their initial assignment,and whenever a new hazard is <br /> 22 introduced into their work area, in violation of California Code of Regulations, title 8 section <br /> 23 5194(h)(1); <br /> 24 j. Failing to restrain machinery and equipment designed for a fixed location so as to <br /> 25 prevent walking or moving from its location, in violation of California Code of Regulations,title 8 <br /> 26 section 3328(4); <br /> 27 k. Failing to either cover or protect by guardrails the unused portions of a service pit <br /> 28 and pits not in actual use, in violation of California Code of Regulations,title 8 section 3213; <br /> -4- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
