1 $ 3,000.00-On or before JULY 1, 2018 2 $ 1,500.00-On or before JULY 1,2019 3 b. $ 3,750.00 made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL 4 HEALTH DEPARTMENT-ENVIRONMENTAL HEALTH DIVISION TRUST, as per the 5 following payment schedule: 6 $ 1,500.00-On or before JULY 1, 2019 7 $2,250.00-On or before JULY 1,2020 8 c. $ 3,750.00 madepavable to the SAN JOAQUIN COUNTY OFFICE OF THE 9 DISTRICT ATTORNEY, as per the following payment schedule: 10 $ 750.00-On or before JULY 1, 2020 11 $ 3,000.00-On or before JULY 1,2021 12 Said payments shall be delivered to the San Joaquin County Office of the District Attorney, 13 Environmental Prosecutions Unit. 14 7. Defendant shall be penalized, as and for civil penalties, pursuant to Business and 15 Professions Code sections 17200 et seq.,in addition to those civil penalties set forth in paragraphs 6, 16 ONE HUNDREDTHOUSAND DOLLARS ($100,000.00). However, it is stipulated by all parties 17 that the entire additional ONE HUNDRED THOUSAND DOLLARS ($100,000.00), in civil 18 penalties shall be stayed for a period of seven(7)years on the following conditions: 19 a. Defendant will not violate Health and Safety Code sections 25100 et seq., as 20 described in paragraph 3 above; 21 b. Defendant will not violate Health and Safety Code sections 25500 et seq., as 22 described in paragraph 4 above; 23 c. Defendant will not violate or engage in any of the unlawful acts of unfair 24 competition as specifically set forth in the First,Second, and Third Causes of Action of the 25 Complaint filed in this action. 26 8. The ONE HUNDRED THOUSAND DOLLARS ($100,000.00)in civil penalties, 27 described in paragraph 7 above, shall immediately be due and payable as set forth in paragraph 7 28 above, if the San Joaquin County Office of the District Attorney files Declarations that Defendant -6- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
